Introduction.

EmptyChair, LLC and its affiliates (collectively, “EmptyChair” or “We” or “Us”) takes Your privacy seriously. This Privacy Policy describes how EmptyChair collects, uses, and discloses information that We receive from visitors to Our website (www.emptychair.biz) or mobile applications, as well as information We receive from email or text messages between You and Us (collectively, the “Site”), pursuant to federal and state laws and best practices designed to protect You and Your private information.

This Privacy Policy is incorporated into the EmptyChair Terms of Use (available at (www.emptychair.biz), which govern Your use of the Site.  Defined terms from the Terms of Use apply to the Privacy Policy unless otherwise defined.  By using the Site [or by clicking to agree to the Privacy Policy], You accept and agree to the policies and terms outlined in this Privacy Policy, and You hereby consent that We will collect, use, and share Your information in the ways described in this Privacy Policy.  If You do not agree, You must not access the Site.  Further, if You use the Site on behalf of someone else (such as Your child), You represent that You are authorized to accept this Privacy Policy on their behalf.

What Kind Of Information We Collect.

Except as otherwise provided herein, We only collect information that would personally identify You or relates specifically to You (“Personal Data,” which includes personally identifiable information or personal information under applicable data privacy laws and regulations) if You choose to provide it. The Personal Data that You voluntarily submit, such as information to register an account with EmptyChair, to complete forms, to schedule an appointment with a Provider, or to pay for a service offered through the Site (the “Service”), is shared only with the EmptyChair personnel and partners, as well as Providers, who need this information to provide the Services and only to the extent such information is reasonably necessary to do so.  Such Services include facilitating the scheduling of an appointment between You (or your pet) and a Provider whom you agree to see, and sharing information with the applicable Provider to the extent to such information is necessary to facilitate the scheduling of Your appointment.  The Personal Data that You voluntarily submit may also be utilized to address any inappropriate use of the Site.

In addition to collecting information that You voluntarily submit, We may also automatically collect passive information from You that is not likely to be identifiable to You (“Passive Information”).  Such Passive Information may be related to Your equipment, browsing actions, and patterns, and may be used to improve the Site, Your experience with the Site, and the experience for other users with the Site. Specifically, We may collect the following Anonymous Information:

A.   Cookies and Other Tracking Technology.  We may collect information about visitors to the Site using “cookies” and similar technology such as web beacons, web bugs, pixel tags, and so on. We may use this technology to recognize a repeat visitor and offer the visitor a set of services or information requested in a previous visit. We may use session cookies to track a visitor’s path through the Site during a visit, to help Us understand how people use the Site.

B.    IP Addresses.  The web server automatically collects the Internet Protocol (“IP”) address of the computers that access the Site. An IP address is a number that is assigned to Your computer when You access the Internet. It may not be considered personally identifiable information in the sense that many different individuals can access the Internet via the same computer. We use this information in aggregate form to understand how Our Site or advertisements are being used and how We can better serve visitors.

C.    Surveys.  We may occasionally survey visitors to the Site.  The information from these surveys is used in aggregated, de-identified form to help Us understand the needs of Our visitors so that We can improve the Site.  The information may be shared with third parties with whom We have a business relationship.  We generally do not ask for information in surveys that would personally identify You; if We do request contact information for follow-up, You may decline to provide it.  If survey respondents provide personal information (such as an email address) in a survey, it is shared only with those people who need to see it to respond to the question or request, or with third parties who perform data management services for Our site.  Those third parties have agreed to keep all data from surveys confidential.

Lastly, We may also receive information about You from some of Our service providers who assist Us with marketing or promotional services, or from Our other partners.

How We Use The Information We Collect.

We use the information We collect, including Personal Data and Passive Information, for the following:

We will retain Your information for as long as Your account is active or as needed to provide You with Services, comply with Our legal obligations, resolve disputes, and enforce Our agreements.

Some of the information We collection is not Personal Data, including non-identifiable information derived from Personal Data that We have properly de-identified or aggregated in accordance with applicable laws (“Non-Identifiable Data”).  We may use or disclose Non-Identifiable Data for any purpose permitted by applicable law, including without limitation for enhancing Our understanding of who uses the Site and how.

We May Share Some Information to Third Parties.

We do not sell Your personal information to any persons or organizations. We may share Your Personal Data with third parties who We have engaged to help Us provide Services and operate Our business. In each case, We will ensure that these third parties have agreed not to use or disclose Your Personal Data except to help Us provide the Services and operate Our business.

In the event of EmptyChair undergoing a merger, acquisition, or other transaction that results in a third party assuming control of the EmptyChair business, Your Personal Data may be transferred to that third party.  If such an event were to occur, We would make reasonable efforts to notify You of the transfer beforehand.

In addition to the foregoing, We may disclose Your Personal Data for authorized law enforcement investigations or to comply with Our legal obligations as permitted by applicable laws in Our reasonable judgment.

Payment Processing.

If You elect to pay for Services offered on the Site, You will be connected to Our payment processing partner Stripe.  Stripe collects Your voluntarily provided payment card information necessary to process Your payment.  You may review Stripe’s terms of service and Privacy Policy for information on its use and storage of Your personal data.

Protecting Your Privacy.

The security of Your Personal Data is important to us.  We use reasonable security measures to protect the confidentiality of personal information under Our control and appropriately limit access to it. We use a variety of information security measures to protect Your online transactions with us. However, EmptyChair cannot ensure or warrant the security of any information You transmit to Us via any medium, and You do so at Your own risk. We have taken reasonable steps to ensure the integrity and confidentiality of Personal Data that You may provide. You should understand, however, that electronic transmissions via the Internet cannot be guaranteed to be secure from interception, and so We cannot absolutely guarantee the security or confidentiality of such transmissions and information.

To further protect Your privacy, You should refrain from sharing Your passwords, and You may choose to cancel Your account or request that We no longer use Your information to provide You services at any time.

Miscellaneous.

A.   Protecting Children’s Privacy

We are committed to protecting children’s privacy on the Internet, and We do not knowingly collect personal information from children.

B.    HIPAA

This Privacy Policy does not apply to protected health information (“PHI”), which is governed by the Health Insurance Portability and Accountability Act (“HIPAA”).  EmptyChair is not a Covered Entity nor a Business Associate to a Covered Entity, and does not collect PHI.  Please refer to Your healthcare provider for any questions You may have about their practices regarding the privacy and security of Your PHI.

C.    Third Party Links

Some content or applications, including advertisements, on the Site may be served by third parties, including advertisers, ad networks and servers, content providers, and application providers.  Our policies, including Our Privacy Policy, do not apply to any external sites.  Such third party sites may use cookies or other track technologies to collect information about You when You use Our Site.  The information they collect may be associated with Your Personal Data or they may collection information about Your online activities over time and across different websites and other online services, and they use this information to provide You with interest-based (behavioral) advertising or other targeted content.  We do not control these third parties’ tracking technologies, privacy policies, practices, or how they may be used.  If You have any questions about an advertisement or other targeted content, You should contact the responsible party directly.

D.   Privacy Policy Updates

We may need to update Our Privacy Policy as EmptyChair evolves.  All changes are effective immediately, and it is your responsibility to check this page as necessary to ensure You are aware of any changes.  If We make significant changes to the Privacy Policy, we’ll make a good faith effort to post a prominent message on the Site where applicable.
